Your privacy is very important to Winc Academy B.V. (hereinafter: Winc Academy). This statement explains how we collect, process, secure and store your data in accordance with the General Data Protection Regulation (GDPR). This means that:

  • Clearly define our purposes before we process your personal data, via this privacy statement;
  • Store as little personal information as possible and only the data that is necessary for our purposes;
  • Explicitly request permission to process your personal data, if consent is required;
  • Take necessary security measures to protect your personal information. We also impose these obligations on parties that process personal data for us;
  • Respect your rights, such as the right to view, correct or delete your personal data processed by us.

Good to know is that Winc Academy does not use automated decision-making. And that under no circumstances are special and/or sensitive personal data requested.

For what purposes do we use your personal data?

Winc Academy processes personal data for the following purposes:

  • Registration and guidance: Processing registrations and providing personalized guidance during the course.
  • Access to the online learning environment: Managing accounts and progress information.
  • Certification: Sharing achieved results with the certification partner for issuance and verification of certificates.
  • Administration and billing: Processing payments, purchases, study periods, progress and any data exchange with grant partners (if applicable and as agreed).
  • Quality improvement: Analyzing data to improve the learning experience and services. Where possible, we anonymise this process.
  • Marketing and communication: Sending personalized messages after permission, such as follow-up to webinars, training updates and other relevant information.
  • Legal obligations: Sharing progress or other relevant data with grant partners, such as UWV or municipalities, if contractually or legally required.

Registration for or orientation to training

Via our website www.wincacademy.nl, you can sign up for one of our courses, more information, orientation tests or events, such as a free webinar.

For this purpose, depending on your interaction with us, we process the following data:

  • Name and address details
  • Telephone number
  • E-mail address
  • Correspondence
  • Data and results from any tests
  • Company name

This information helps us to offer you the right training and to prepare for a possible agreement. Contact details will only be used for further follow-up if you have consented to receive marketing activities.

Sign up for a course

When you sign up for one of our courses, we process the following personal data:

  • the information you provided when purchasing the course, including your first and last name, email address, address details, payment details and the chosen course;
  • information about the start date of your course and the associated study deadline;
  • payment and billing information;
  • details of your employer or subsidy provider (if you purchase the course through or together with them). This information is provided to us by you or by the relevant employer or subsidy provider. We do not collect this information independently;
  • any correspondence between you and Winc Academy, for example via e-mail.

We process this personal data to execute the agreement that we enter into with you. Based on your registration, we will create an invitation for a personal account in our online learning environment (LearnAMP). You will receive an invitation to do so by email. The account will not become active until you accept this invitation and agree to LearnAmp's applicable terms and privacy statement. You can use these terms here find, but also when you create an account or will log into the platform. The processing of this data is necessary to provide our educational services as an online trainer.

Participate in training in the learning environment

After you register and accept the invitation to the learning environment, you can log into your personal account in our online learning environment. Through this account, you have access to the course material for your course (s), you can monitor your academic progress and study activity, and you can find the various options for guidance.

Winc Academy is a fully online trainer. In order to offer our courses, students make use of a personal online learning environment. This learning environment is offered via LearnAMP, an external learning environment (Learning Management System - LMS). By accepting the invitation and using the learning environment, you agree to LearnAMP's privacy statement and terms of use. These terms are available via LearnAmp and are also displayed when creating an account and logging into the platform.

Using your account, we process personal data about your study activity and educational progress. Specifically, this concerns:

  • time of login (date and time);
  • how long you have been active in the learning environment (study time in minutes);
  • your educational progress (which components have been completed/what are you currently working on);
  • participation in online coaching sessions or events (such as 1-on-1 sessions or webinars);
  • your name, email address, course and study deadline.
  • language preference and time zone
  • documents uploaded by you (such as assignments and projects)
  • our feedback on your assignments and final projects
  • any profile photo or other information that you voluntarily add to your profile (such as a bio or messages).

We process this data to execute the training agreement with you and to optimally support your learning process. This processing is necessary for the online learning environment to function properly and to provide our educational services. Among other things, we use this information to:

  • giving you access to the right course material;
  • to keep track of your academic progress and to automatically move on to the following sections;
  • to be able to provide tutoring and coaching, for example when planning and progress discussions;
  • determining when a course has been successfully completed and a certificate can be issued;
  • to have insight into participating in coaching sessions for which you have registered, so that our team is available at the right times.

Recording study activity is comparable to attendance in physical education and is necessary to provide you with adequate guidance and to provide our educational service as an online trainer.

We keep your personal data for as long as necessary for the execution of the agreement, to maintain valid certificates and to make reactivation or further training possible, unless you request deletion earlier.

Marketing communications

Winc Academy only sends newsletters, marketing emails and other forms of marketing communication if you have explicitly given permission (opt-in). In this communication, we can inform you about our courses, services, events, brochures, test results or relevant offers.

The processing of personal data for marketing communications takes place on the basis of your consent within the meaning of Article 6 (1) (a) of the GDPR. This permission is obtained via our forms, for example when requesting a brochure, taking a test or signing up for a webinar.

You can withdraw your consent at any time via the unsubscribe link in each email or by contacting us at welkom@wincacademy.nl. If you opt out of marketing communications, we will only process your data for administrative purposes or to ensure that you do not receive any further marketing messages from us as long as you study with us or are in contact with us.

  1. Webinars

Winc Academy organizes webinars to inform interested parties about our courses and job opportunities. These webinars are aimed at people who are looking for training at Winc Academy. Registration for a webinar expires via our website. Participation in a webinar is only possible after you have explicitly given permission to process your personal data as described below.

When registering and participating in a webinar, we process the following personal data: first and last name, place of residence, email address, telephone number, the chosen webinar and the date & time of participation and attendance.

We process this personal data to organize, conduct and contact you about the webinar, including follow-up to the webinar and information about our courses, services and events.

The processing of personal data in the context of webinars takes place on the basis of your consent within the meaning of Article 6 (1) (a) of the GDPR. You can withdraw this consent at any time. Withdrawal of consent does not affect webinars that have already been followed, but may mean that you will not receive any further communication from us.

Providing personal data to third parties

We only share your personal data with third parties when permitted by law. We have concluded agreements with these third parties so that they maintain the same high standards of security and confidentiality as we do.

We may share your information with third parties for the following reasons:

  • When it is necessary to execute the agreement with you
  • When you have explicitly given permission to do so
  • When we have a legitimate interest
  • When this is required by law (for example, in case of a police request in connection with a criminal investigation)

The categories of parties with whom we may share personal data are:

  • IT suppliers and hosting parties
  • Subsidy or funding partners (if applicable)
  • Self-employed, hired teachers
  • Your employer (if applicable)
  • Cookie service providers

Deleting data

We use the following rules for storing and deleting personal data:

  • Students and alumni: data is stored as long as you follow or have completed a course with us. This allows us to validate certificates, support former students with further education and, upon request, reactivate an account in our learning environment without losing important data.
  • Inactive accounts: If you are not or have not completed any training with us and are not signed up for our marketing activities, your data will be automatically deleted 5 years after the last activity.

Deletion upon request: You can request to have your data completely deleted at any time by sending an email to welkom@wincacademy.nl. Please note that certain data, such as invoices and payment details, may not be deleted immediately due to legal retention periods.

Data processing outside the EEA

In order to provide our services, we use external systems and service providers. This may mean that personal data is processed or stored outside the European Economic Area (EEA). We only do this if there is an appropriate level of protection, for example through standard contractual clauses from the European Commission (such as with the UK) or other legally approved guarantees.

Data breaches

In case of data breaches that pose risks to you, we report this to the Data Protection Authority and inform those involved if necessary.

At Winc Academy, we use cookies and similar technologies to make our website work, improve it and provide personalized content. Cookies are small text files that are placed on your device to store information about your website visit.

The 30-day period may be extended for reasons related to the specific rights of data subjects or the complexity of the request. If we extend this period, we will inform you in good time. If we are unable to comply with your data, for example due to a legal retention obligation, we will also inform you in good time.

At Winc Academy, we strive to provide everyone with the best learning experience. However, it is possible that you are not satisfied. In that case, you can file a complaint using the procedure below.

Please send an email to welkom@wincacademy.nl with a clear description of your complaint.

  • You will receive a confirmation of receipt within 2 weeks.
  • Within 4 weeks of receiving the complaint, you will receive a substantive response.
  1. Delay of treatment

If we need more time to deal with your complaint, you will receive a message explaining this and the expected processing period.

  1. Confidentiality and independent review
    • Your complaint will be treated confidentially.
    • The complaint will be dealt with within 6 weeks by an independent employee of Winc Academy.
  2. Disagree with the outcome?
    • If you feel that your complaint has not been dealt with correctly, you can contact the NRTO Disputes Committee at www.degeschillencommissie.nl.
    • In cases that are privacy-related, you can contact the Data Protection Authority (AP) at www.autoriteitpersoonsgegevens.nl.
